This is a legal binding document between Andria Weaver of Andria's Photography, and the listed Client names Bride & Groom above, hereon referred to as client.
Andria's Photography agrees to photograph the wedding of the above named Client occurring on Event Date listed above.
Client agrees to the payments being paid directly to Andria's Photography for the agreed services, of which a non-refundable retainer is due. Once payment is received, the wedding date will officially be placed on Andria's Photography's calendar.
Provisions:
(a) The signing of this contract by the Client constitutes a commercial model release by the Clients to Andria's Photography. Andria's Photography will have the right to make reproductions included but not limited to website, portfolio samples, self-promotion, magazine editorial use, advertisement/marketing and professional completion without further release.
(b) Andria's Photography reserves the right to refuse to offer services or products due to non-payment.
(c) In the rare occurrence that one or both photographers are unable to shoot the event, replacement will be found on the behalf of the Client at Andria's Photography's expense. In the event of such substitution, Andria's Photography warrants that the photographer taking the photographs shall be competent professional.
(d) It is understood that the Client is hiring Andria's Photography for their technical and artistic expertise and, therefore, Andria's Photography reserves the right to shoot, edit and proof at their discretion. Client is not to make edits, add filters, crop or edit photos in any way.
(e) Andria's Photography will abide by the rules of the venue in regards to camera placement and restrictions at the ceremony.
(f) Andria's Photography will not be liable for loss of or interference with photography due to restrictions on the location, including but not limited to, interference from surrounding devices, access limitations, flash restrictions, weather and the like.
(g) No unauthorized professional photography is allowed on wedding date. Andria's Photography shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding.
(h) It is asked that family and friends do not interfere (standing in front of or behind the photographer) with Andria's Photography's duties and do not photograph poses arranged by Andria's Photography.
(i) Andria's Photography does not guarantee that everyone involved in the event will be photographed or will be included in the final images. Andria's Photography's focus is the bride and groom and the events surrounding them throughout the wedding day. If it is important for the bride and groom to have coverage of the wedding guests who may be on the outskirts of the action, it is suggested that Client purchases through Andria's Photography an additional shooter.
(j) Andria's Photography agrees to give its best efforts, but Client understands the unpredictable and non-posed nature of photojournalism and waives any right to any civil action due to missed or lost photographs (including but not limited to unintentional infliction of emotional distress and negligence).
(k) Andria's Photography will not be held responsible for circumstances beyond human control for lost images.
(l) Images will be available for clients to purchase at viewing session which will be held no later than (90) days after the photo session (engagement/wedding day).
(m) Andria's Photography will work solely with the Bride & Groom, or persons designated represented by Bride & Groom, when it comes to ordering, proofing, and shipping final products. Clients may bring family to ordering session.
(n) Andria's Photography has the right to make the final decisions on images selected for publications.
(o) Andria's Photography is not responsible for manufacturer or shipping delays.
(p) All unordered or unapproved produced, unused print credits and gunshot sessions will expire six months after wedding date.
(q) If any modifications need to be made with any of the products received, all requests must be made within 30 days of receiving the items.
(r) Andria's Photography is not responsible for any products, prints that are printed outside of Andria's Photography.
(s) Andria's Photography may take a 30 minute break during the time of Clients meal, Andria's Photography may eat and will not be responsible for taking photos during this time (If wedding duration is longer than 4 hours).
Clauses:
1: This contract represents the parties' entire agreement on this matter, superseding all previous negotiations or agreements whether oral or written
2: The law of Colorado shall govern, construe and enforce all of the rights and duties of the parties arising from or relating in any way to the subject matter of this contract.
3: Any action, proceeding or litigation relating to or arising from this agreement shall be brought in Colorado, United States.
